As-Salāmu ʿAlaykum Wa-Raḥmatullāhi Wa-Barakātuh
In principle, waqf property must be managed in accordance with the purpose and best interests of the waqf. Therefore, the land of a masjid remains waqf and cannot be appropriated as the private property of any individual. However, the authorized management may regulate its use in a manner that serves the legitimate interests of the masjid and its users.
Accordingly, it is permissible for the trustees of the waqf to designate a parking space for the Imām if there is a need to do so (where parking space at the masjid is limited). Likewise, it is permissible to designate parking spaces for paraplegic or otherwise disabled persons to facilitate their access to the masjid. In both cases, the designation is merely an arrangement for the use of the waqf property and does not establish a private proprietary right.[1]
