Inheritance of siblings

Question:

Assalamalaykum Mufti, hope you are doing well.

If a lady passes away with no husband & children but had a house that was sold after her passing by her siblings, how will the property be divided among the remaining siblings. In this case there are 2 sisters and four brothers.

There is some confusion on whether it is divided equally or not.

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-Salāmu ‘Alaykum Wa-Rahmatullāhi Wa-Barakātuh.

According to the Islamic laws of inheritance, distribution of an estate will only commence once funeral expenses, debts, and bequests made to non-heirs (from 1/3 of the remaining estate after funeral expenses and debts) are settled in that order.[1]

Thereafter, all remaining assets will make up the net estate. Based on the information provided, the estate will be divided into 10 equal shares and will be distributed as follows:

Brother 2 20%
Brother 2 20%
Brother 2 20%
Brother 2 20%
Sister 1 10%
Sister 1 10%
Total 10 100%
